"Popcorn Terms and Conditions of Sale"

Popcornlive.co.uk is the trading name of Popcorn. The following are terms and conditions for the sale of goods that will govern any contract for sale that we enter into without exception.
Please read these terms and conditions carefully.
- These terms and conditions do not affect your statutory rights.
- We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
- To order goods through this website you must be at least 18 years of age.
- Goods are subject to availability. If we do not supply the goods for any reason we will not charge you for these goods and we will refund any money already paid for the goods. However, we will not be responsible for compensating you for any other losses which you may suffer if we do not supply goods.
- Many of the products we sell are of a technical nature and it is not practical to publish detailed specifications of all the products and keep specifications 100% up to date. All drawings, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods. However, if you purchase any goods that are unsuitable, you have the right to return these for refund of order (including the price of goods, and our postage charge) within 7 working days.
- We will endeavor to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside of our control, such as supply failures or discontinuation of lines. Due to the volatile nature of the toy market release dates of products are subject to change. We will also not be held liable for any delays due to acts of God, civil commotion, riots, industrial action, drought, fire, floods or fuel shortages. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods unless caused by our negligence.
- Popcorn charge a flat-rate postage fee for all orders. Our actual cost in posting varies due to the weight of goods. In the event of us re-shipping goods, or refunding orders (for reasons other than the fault of Popcorn, or outside the 7 working days cooling off period) will be billed (in the case of a reshipping fee) or refunded (in the case of a return) at our actual costs. For parcels over 2kg in weight, there may be a surcharge for the cost of postage if the delivery address is not within mainland UK. If your order falls into this category, then you will be sent an email informing you of the charges.
- In the event of you wishing to return goods for refund, where the return is due to no fault of Popcorn, we will not refund the costs of you returning the parcel to us. It is your responsibility to ensure that non-faulty goods are returned in a saleable condition, and where applicable with all relevant instructions manuals, parts and accessories.
- Important Notice: If goods arrive in a damaged condition please inform us as soon as possible in order to rectify the situation. Our Returns Department will arrange the return of these goods and we will replace the goods at no extra charge or issue a refund. We must be advised within 5 working days of any damaged deliveries so we can investigate with our couriers.
- Should delivery be delayed for more than 30 days you have the right to contact us prior to dispatch and cancel the order without any further obligation. In this case we will refund any money paid by you for the goods.
- As soon as we have delivered the goods you will be responsible for them. If you delay accepting a delivery, our responsibility for everything other than damage due to our negligence will end on the first date the carrier tried to deliver the goods to you.
- The price for the goods will be as stipulated at the time when you place your order. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any new taxes or duties, or if due to an error or omission the price published for the goods on our website is wrong. We will inform you of the correct price and give you an opportunity to cancel the order.
- All prices on our website are inclusive of VAT but exclusive of delivery and insurance charges which will be payable as indicated at the time of placing your order.
- We have the right to terminate any contract between us without penalty. In the event of termination we shall refund to you all sums paid by you to us.
- You will only own the goods once we have received payment in full.
- We do not offer any credit facilities. We will issue you with an invoice once we have received payment in full for your order and once we have dispatched the goods to you.
- If you order software from us, a license to use the software is supplied with the product by the publisher of the software. You are required to comply with the terms of the software license as well as these terms and conditions.
- All images on this site are for illustration purposes only and may not be the exact products on sale. We attempt to keep an accurate representation of all products on our site at all times, however products are frequently subject to redesign of packaging or the products themselves. We can take no liability for erroneous images, however you have the right to return goods within the legal cooling off period of 7 working days should they not be suitable.
- Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.
- The Contract between us shall be governed by the laws of England and Wales and any dispute will be resolved exclusively in the courts of England and Wales. We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise. If you have a complaint contact us at support@popcornlive.co.uk.
- Any orders placed through popcornlive.co.uk (either online or by telephone/mail order) are subject to these terms and conditions.
- Any unwanted goods that are to be returned to Popcorn are the full responsibility of the customer, All postage costs are to be covered by the customer. If the items are to be replaced, the costs of sending out a replacement are also to be covered by the customer.
- Due to changes in our courier's policy, City Link will now attempt to leave undelivered orders with a neighbour. If customers do not wish for this to be done, they need to state this in the Special Instructions section when ordering.
- These terms and conditions are subject to change at any time without prior notice.
